What are the FIDIC claim notice periods?
Short answer: FIDIC 1999 Clause 20.1 and FIDIC 2017 Sub-Clause 20.2.1 require a Notice of Claim within 28 days of becoming aware of the event. The fully detailed claim follows within 42 days (1999) or 84 days (2017), with interim updates monthly for continuing events.
- Notice of Claim: 28 days after the contractor became aware, or should have become aware, of the event (both editions).
- Fully detailed claim: 42 days (1999) or 84 days (2017) after awareness, or another period agreed with the Engineer.
- Continuing effect: interim claims monthly, final claim 28 days after the effect ends.
- Engineer's response: 42 days under both editions (FIDIC 2017 sets out the determination process in Sub-Clause 3.7).
Late notice can bar the claim under both editions, so the dates matter. The free notice calculator gives every date and a calendar file. This is general information; the particular conditions of your contract may change the periods.
